1- Definitions
For the purpose of purchasing from the website ciocca.it of Ciocca products and in relation to the contractual terms regarding online sales, the following terms mean: Seller: the company Ciocca S.p.A., located in Quinzano d'Oglio (BS), via Luigi Ciocca, 11, Tax Code 00283120178 / VAT 00549760981 that produces and/or sells products through the website Ciocca.it Customer: the subject, natural or legal person, who purchases products through the website Ciocca.it Consumer: customer protected by the Consumer Code regulations (Legislative Decree 206/2005) as a natural person who purchases the product for purposes unrelated to their professional activity Product: the good or goods described in the online catalog and purchasable from the website Ciocca.it, produced and/or marketed by the seller Contract: the sale agreement that is completed by the meeting of the customer's will to purchase the product, expressed by filling out the forms in the "REGISTER NEW USER" section (for users not yet registered on the site) or "REGISTERED CUSTOMERS LOGIN" or "ALREADY REGISTERED USER" (for users already registered on the site) of the website Ciocca.it according to the procedure described in points 2 and 3 of these terms, with the seller's will to sell the product, expressed through acceptance and transmitted in the manner described in point 3 Withdrawal: the manifestation, by the consumer, of the will to renounce the already completed purchase, taking advantage of the protection offered by the Consumer Code (Articles 64ff Legislative Decree 206/2005) and better described in point 6.
2- Purchase procedure
The products that can be purchased from the website Ciocca.it are exclusively those indicated and described in the online catalog, which can be consulted on the pages "men", "women", "unisex", "children", "baby", "promotions", "new arrivals" of the site. The customer purchases by filling in all fields of the forms contained in the pages "REGISTER NEW USER" (for users not yet registered on the site) or "REGISTERED CUSTOMERS LOGIN" or "ALREADY REGISTERED USER" (for users already registered on the site) of the website Ciocca.it. Confirmation of the customer's intention to purchase is given only by selecting the "PURCHASE" icon on the "ORDER SUMMARY" page. Until said confirmation is given, the customer can return to previous pages and modify the data entered therein. In any case, the page containing the confirmation "PURCHASE" icon provides and summarizes all relevant data for the purchase and in compliance with the Consumer Code regulations (Article 52 Legislative Decree 206/2005).
The confirmation of the purchase proposal by the customer is preceded by checking the "I accept the conditions" checkbox (during user registration) with which the customer declares to have read these general terms, to have obtained all necessary information for the conscious choice to purchase the product as well as to have obtained information on the processing of personal data pursuant to Legislative Decree 196/2003. If the customer is also a consumer, at the end of the purchase procedure they must print or save in virtual form these general terms as established by the Consumer Code (Article 50ff Legislative Decree 206/2005).
3- Contract conclusion
The contract is concluded with the seller's acceptance of the purchase proposal made by the customer in the forms regulated by these contractual terms. In particular, the seller confirms receipt of the purchase proposal and accepts it by summarizing all data through a confirmation email that is automatically sent to the customer after receipt of payment. The sending of the confirmation email has the value of acceptance for all legal purposes and determines the completion of the contract. The customer is required, in any case, to verify the accuracy of the data contained in the confirmation email and to immediately communicate any anomalies and discrepancies to the seller who will make corrections before shipping the goods.
The confirmation email contains, among other things, the order code that the customer must reference in all communications with the seller, including withdrawal requests. The seller is free to accept or not accept the customer's purchase proposal. In case of non-acceptance, the seller will promptly inform the customer via email and will also provide a refund of the payment previously made through the methods indicated in the next point.
4- Product payment
Payment can only be made through one of the following methods: must be made simultaneously with the confirmation of the purchase intention by selecting the "BUY" icon on the "ORDER SUMMARY" page, which will redirect the customer to the website www.paypal.com where payment must be made. must be made by bank transfer in advance, using the details provided below. Product shipment is subject to payment completion.

5- Product Shipping and Delivery
The seller can accept purchase proposals from customers residing or domiciled in Italian territory or, in any case, ship the product exclusively to destinations located in Italian territory.
Shipping costs are €5 per order and free for orders over €25.
The product is shipped via BRT or Fedex or TNT courier.
Shipping occurs within 1/3 days (excluding Sundays and holidays) from payment completion made by credit card or advance bank transfer, depending on the payment method chosen by the customer during purchase. Delivery will take place on working days and in case of non-receipt, the courier will attempt delivery again on the next working day, providing, in case of persistent impossibility, the posting of a failed delivery notice containing an invitation to collect from the courier's warehouse. Alternatively, the courier may contact the customer by phone, trying to arrange delivery of the goods. If not collected from the courier's warehouse within 10 days, the product will be returned to the seller.
In the exceptional case of product unavailability or impossibility for other reasons to ship within the expected terms, the seller will communicate the reasons to the customer and return any amount collected from the customer by credit card refund, through PayPal service, or by bank transfer refund, depending on the payment method chosen by the customer during purchase.
No compensation will be recognized to the customer for failed delivery in any case. The customer must verify the product's correspondence to contract specifications and the absence of tampering with product packaging. In case of non-correspondence or tampering, the customer must indicate on the delivery form presented by the courier that acceptance is made with reservation and specify the reasons. Immediately after and in any case no later than 2 days from product receipt, the customer must send an email to the seller, through the appropriate electronic form accessible at the "REQUESTS" page of the website Ciocca.it, describing the nature and quantity of any anomalies found. In case of signature for product receipt without further indications or in case of anomalies found at delivery and failure to communicate them by email within the aforementioned term, the goods will be considered compliant with the contract and as such accepted without reservation by the customer.
6- Right of Withdrawal and Product Return
In case the customer is also a consumer, pursuant to Articles 64ss of the Consumer Code (Legislative Decree 206/2005), the customer-consumer can exercise the right of withdrawal without giving any reason.
The right of withdrawal must be exercised within and no later than 14 working days from the date of receipt of the goods.
The right of withdrawal must be exercised in one of the following forms: Return shipping to the seller: through the courier indicated by customer service whose cost will be borne by the seller, in case the product is damaged or defective, wrong due to internal company errors. The customer must complete the goods return form located on the "CONTACT US" page of the website Ciocca.it, taking care to indicate the order code. Delivery to the courier for return shipping must take place within 3 working days from the completion of the aforementioned form.
Product return to seller: With shipping costs charged to the customer for dissatisfaction or customer error: If you wish to return a product due to personal dissatisfaction or errors made during purchase (for example, wrong size or color selected), the return shipping will be charged. You have two options to make the return:
I. Shipping through our contracted courier: in this case, you will be charged a fixed cost of €5, which will be deducted from the refund amount. Our customer service will provide you with a prepaid shipping label to use for returning the item.
II. Shipping through a courier of your choice: if you prefer to use a courier different from the one contracted with Ciocca.it, you will have to pay the shipping cost directly to the courier. Please note that Ciocca.it will not be responsible for any loss or damage to the package during transport, therefore we recommend using a trackable and insured shipping service.
The seller will refund the amount paid by the customer-consumer within 30 working days from receipt of the goods, by credit card refund through PayPal service or by bank transfer refund, depending on the payment method chosen by the customer during purchase, except as provided in case of receipt of damaged product. Upon receipt of the product, the seller will verify its condition and quantity of items. a. In case of damage to packaging, the value of the packaging to be restored/replaced will be deducted from the amount to be returned to the customer-consumer, not exceeding 20% of the purchase price. b. In case of damage or excessive wear of the item incompatible with mere fitting trials, In addition to the conditions previously described, it is specified that for purchases of socks or underwear, in compliance with hygiene and health regulations and to ensure consumer health protection, the right of withdrawal can only be exercised if the products have not been worn. If such items are returned and it is evident, through appropriate verification upon receipt, that the products have actually been worn, even just for trying on, the customer-consumer's right of withdrawal will expire. In this case, the seller will not make any refund and the product will remain in custody at the seller's premises where it can be collected at the customer-consumer's expense within 6 months from receipt. In both cases, the seller will communicate via email to the customer-consumer the quality and extent of damages found during inspection.
7- Product replacement
In addition to the right of withdrawal and product return, the customer-consumer has the possibility to request the replacement of the purchased product with another of equal value or with one of different value subject to possible economic adjustment. Product replacement is subject to warehouse availability of the requested replacement product.
To request product replacement, the customer-consumer must fill out the merchandise return form located on the "CONTACT US" page of the website Ciocca.it, making sure to indicate the order code and the desired replacement product. Delivery to the courier for returning the product to be replaced must occur within 3 working days from completing the aforementioned form.
Shipping costs for product replacement are divided as follows:
a) If the replacement is due to product damage or defects, or internal company errors, shipping costs will be borne by the seller.
b) If the replacement is due to personal dissatisfaction or errors made by the customer during purchase (for example, wrong size or color selected), shipping costs for returning the product will be charged to the customer, according to the methods described in the "Product return to seller" section of point 6. Additionally, shipping costs for sending the replacement product will be charged to the customer. The seller will communicate to the customer the cost of shipping for sending the replacement product and the customer must pay these costs before the replacement product is sent.
The seller will send the replacement product within 14 working days from receiving the original product and payment of shipping costs for sending the replacement product, provided that the replacement product is available in stock. Otherwise, the customer-consumer will be informed about the expected timing for sending the replacement product or will be offered the possibility to choose an alternative product or exercise the right of withdrawal and obtain a refund according to the methods provided in point 6.
8- Warranty
Products purchasable from the website Ciocca.it, produced and/or marketed by the seller are guaranteed for a period of 24 months from the date of receipt in case the purchase is made by a consumer. The warranty is provided on condition that the consumer promptly reports to the seller any defects or non-conformities found in the product and in any case no later than 2 months from discovery. The seller will provide for the replacement of the product or the payment of a sum to reduce the sale price and to compensate for the same defects or flaws, except, in any case, as regulated by consumer protection rules provided by the Consumer Code (art. 130 D.Lgs. 206/2005). The seller also reserves the right to replace the defective or non-conforming product with a product having equal or superior quality and characteristics to the originally purchased product. The warranty is not provided in case the defects or non-conformities found are attributable to degradation resulting from normal use of the product. To this end, the seller reserves the right to verify, at its own care and expense, the extent of the alleged defects or non-conformities and, to this end, the consumer facilitates the verification operations.
9- Product Images
The product images displayed on our website, on our sales platforms, and on any promotional materials are for illustrative purposes. We do not guarantee that the appearance, dimensions, or color of the delivered product exactly match these images. The product images on our website and other sales platforms are provided to help customers identify the specific product but do not necessarily represent a perfect representation of the product itself. Additionally, images may be subject to change without notice. We recommend customers contact us for any questions or clarifications before making a purchase. We are committed to providing accurate product information and responding promptly to any questions, but we are not responsible for any discrepancies between the product image and the actual product.
By making a purchase on our website or other sales platforms, the user accepts and acknowledges that product images are provided for illustrative purposes only and do not necessarily represent a guarantee of the exact characteristics of the delivered product.
10- Customer Service
All communications regarding product quality and correspondence to the order, in addition to the forms and purposes regulated in the previous general clauses, can be addressed to the customer care service whose contact details are indicated on the "CONTACTS" page of the website Ciocca.it.
11- Jurisdiction
The contract is understood to be completed and regulated in compliance with Italian Law. For the resolution of disputes relating to this contract, the Court of Brescia has jurisdiction, except in cases where the client is a consumer, in which case, in compliance with the Consumer Code regulations (art. 34 D.Lgs. 206), the Court of reference is that of the client's place of residence.
12- Privacy
All personal data provided by the client in completing the forms referred to in points 2 and 3 of these general clauses as well as all other personal data communicated to the seller are processed in compliance with privacy regulations as per D.Lgs. 196/2003.
